Paschall’s Lawn & Landscape believes good work starts with clear expectations. These Terms of Service explain the general rules for using our website, requesting an estimate, and hiring us for lawn or landscape services.

By using paschallslawn.com, submitting a request, approving an estimate, or hiring Paschall’s Lawn & Landscape, you agree to these terms.

SMS Terms of Service

By providing verbal consent to Paschall’s Lawn & Landscape, you agree to receive SMS messages related to customer conversations and service-related communications. Phone numbers collected as part of the SMS consent process will not be shared with third parties for marketing purposes.

Messages may include customer conversations, service updates, appointment-related communications, estimates, service requests, and customer support.

Estimates and Service Agreements

Submitting a form or contacting us does not create a service agreement or guarantee that we can accept the work.

Before beginning a project or recurring service, we may provide a written estimate, proposal, work order, or service agreement describing the work, pricing, payment schedule, and any additional terms.

If a written estimate, proposal, invoice, or service agreement contains terms that differ from this page, the terms in that document will control for that particular work.

Unless otherwise stated, estimates are based on the property conditions and information available when the estimate is prepared. An estimate may need to be updated if:

  • The requested scope changes
  • Measurements or quantities change
  • Previously hidden conditions are discovered
  • Material or disposal requirements change
  • The customer provides incomplete or inaccurate information
  • Additional labor, equipment, or services are requested

We will communicate material changes before performing additional billable work whenever reasonably possible.

Scheduling

Service dates and arrival times are estimates. Lawn and landscape work can be affected by weather, soil conditions, material availability, equipment problems, traffic, and other circumstances outside our reasonable control.

We may reschedule service when conditions are unsafe or when completing the work could damage the property, equipment, or lawn.

Recurring treatment and maintenance schedules may also shift based on weather and seasonal conditions. Applications are performed according to the needs of the property and the appropriate timing for the service, which may not always fall on the same calendar date each month.

Customer Responsibilities

Customers are responsible for providing accurate contact, property, and service information.

Before we arrive, customers should:

  • Provide reasonable access to the service area
  • Unlock gates or provide necessary access instructions
  • Secure pets and keep children away from active work areas
  • Move vehicles, toys, furniture, hoses, and other items that may interfere with service
  • Tell us about irrigation systems, drainage lines, invisible fences, landscape lighting wires, private utility lines, septic components, or other hidden property features
  • Notify us of known hazards, access limitations, or sensitive areas
  • Provide working irrigation when watering is required for the service
  • Obtain any homeowner association approval or property-owner permission that is not specifically included in our agreement

We will follow applicable utility-location requirements when work involves digging. However, customers must identify privately installed systems or lines that are not normally marked through public utility locating services.

Additional charges may apply if our crew cannot access the property, must make a return trip, or encounters conditions that were not disclosed before scheduling. Any applicable charge will be handled according to the approved estimate or service agreement.

Lawn Treatments and Property Safety

Customers must follow any watering, mowing, access, pet, child, or aftercare instructions provided by our team.

For weed control, fertilization, pest treatment, or similar applications, customers should keep people and pets away from treated areas for the amount of time stated by our team or on the applicable product instructions.

Please tell us before service if anyone at the property has special health, sensitivity, environmental, or access concerns that could affect how the service should be performed.

Plants, Turf, Seed, and Natural Conditions

Lawns and landscapes are living environments. Results can be affected by weather, watering, soil quality, drainage, sunlight, shade, disease, insects, animals, foot traffic, mowing practices, and other conditions outside our control.

We cannot guarantee that every plant will survive, every seed will germinate, or every weed or pest will be permanently eliminated.

Customers are responsible for following the watering and care instructions provided after planting, aeration, overseeding, sod installation, fertilization, weed control, or other services.

Any warranty or callback policy will be described in the applicable estimate, program, or service agreement. If no written warranty is provided, no additional warranty should be assumed.

Existing and Hidden Property Conditions

We take reasonable care while working on your property. However, Paschall’s Lawn & Landscape is not responsible for damage caused by:

  • Preexisting property conditions
  • Unmarked private utilities or underground features
  • Weak, deteriorated, improperly installed, or concealed materials
  • Irrigation components located too close to the surface
  • Weather, erosion, flooding, drought, disease, pests, or animals
  • Work performed by another contractor or property owner
  • Conditions that could not reasonably be seen before beginning the work

Please notify us promptly if you believe our work caused property damage so we can inspect the issue while the conditions are still available for review.

Changes and Additional Work

Requests made after an estimate is approved may be treated as additional work. Additional labor, materials, equipment, disposal, or return visits may result in additional charges.

Our team must approve changes to the scope of work. Instructions given directly to a crew member do not automatically change the approved agreement unless the change is confirmed by an authorized representative of Paschall’s Lawn & Landscape.

Cancellations and Access Issues

Cancellation, rescheduling, deposit, and refund terms may vary by service and will be included in the applicable estimate or service agreement.

If no separate cancellation terms are provided, please contact us as soon as possible if you need to change an appointment. Customers remain responsible for completed work, ordered materials, nonrefundable materials, and other costs already incurred for their project.

We may cancel or decline work when conditions are unsafe, access cannot be provided, requested work would violate the law or product instructions, or a customer engages in threatening, abusive, or inappropriate conduct.

Payment

Pricing and payment terms will be shown in the applicable estimate, invoice, or service agreement.

Customers agree to pay approved charges by the due date shown on the invoice. Deposits, progress payments, late charges, collection costs, or other fees apply only when they are disclosed in the applicable agreement or otherwise permitted by law.

Questions about an invoice should be raised promptly so we can review them.

Communication

When you submit a form, call us, or request an estimate, you authorize Paschall’s Lawn & Landscape to contact you about that request using the phone number or email address you provided.

Submitting a request does not require you to purchase a service.

Website Information

We try to keep the information on our website accurate and current. However, service descriptions, availability, pricing, promotions, photographs, and other website content may change.

Website content is provided for general information and does not replace a property-specific estimate or written service agreement.

Photographs are examples of previous work. Every property is different, and similar results are not guaranteed.

Acceptable Website Use

You may use our website to learn about our services, contact our team, and request an estimate.

You may not:

  • Attempt to interfere with the operation or security of the website
  • Submit false, misleading, fraudulent, or unlawful requests
  • Use automated systems to overload, scrape, or misuse the website
  • Attempt to access information or systems without authorization
  • Copy or use our website content, photographs, branding, or logo without permission

Third-Party Websites and Services

Our website may link to Google, Meta, review platforms, payment providers, social media websites, or other outside services.

Those services are operated independently and may have their own terms and privacy policies. Paschall’s Lawn & Landscape is not responsible for the content, availability, or practices of websites we do not control.

Limitation of Liability

To the extent permitted by law, Paschall’s Lawn & Landscape will not be responsible for indirect, incidental, special, or consequential losses arising from use of the website or our services.

Our responsibility for a service-related claim will not exceed the amount paid for the specific service that caused the claim, except where a different remedy is required by law or stated in a written agreement.

Nothing in these terms limits rights or remedies that cannot legally be waived.

Governing Law

These Terms of Service are governed by the laws of the State of Oklahoma.

Any dispute that cannot be resolved directly between the customer and Paschall’s Lawn & Landscape will be handled in the appropriate state or federal court located in Oklahoma, unless applicable law requires otherwise.

Changes to These Terms

We may update these terms as our website, services, or business practices change. The current version will be posted on this page with an updated effective date.

Changes will not retroactively alter a previously approved written agreement unless both parties agree to the change.
